In the past decade, virtually every government agency with employee-related responsibilities has heightened its pursuit of employers which misclassify individuals as 1) independent contractors when they are actually employees or 2) as exempt employees when they are truly non-exempt. The government views such misclassifications as being unfair to the worker and depriving them (the government) of the revenue (taxes) it would ordinarily collect automatically if the worker is classified properly.  This master class will focus on several key areas and questions that any employer must consider in structuring its worker relationships including: the tests government entities apply to the independent contractor vs. employee question; determining if an employee is exempt or non-exempt from overtime; protection or liability factors when using staffing companies; the consequences of getting it wrong; and more. Come prepared to gain some practical answers and efficient solutions.
